1. Acceptance of Terms

By accessing or using TokHarvest (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service.

These terms apply to all visitors, users, and others who access or use TokHarvest, including the website at tokharvest.com and the desktop application.

2. What TokHarvest Is

TokHarvest is a content management and creator toolkit designed to help content creators organize, manage, and archive media they own or have rights to. It is a productivity platform for creators to protect and preserve their own creative work.

TokHarvest is a content management tool. Users are responsible for ensuring they have the rights to any content they import, store, or manage. TokHarvest does not support unauthorized use or redistribution of third-party content.

TokHarvest is NOT a tool for infringing on others’ intellectual property rights. Any use of TokHarvest to reproduce, store, or distribute content you do not own or have rights to is a violation of these Terms and may be unlawful.

3. Permitted Use — What You MAY Do

You are permitted to use TokHarvest to:

• ✓ Import and archive media you created and published on supported platforms
• ✓ Store and organize content you have received explicit written permission to manage
• ✓ Manage publicly available content for personal, non-commercial research — subject to each platform’s Terms of Service
• ✓ Use saved content for private, personal viewing on your own devices
• ✓ Organize and manage your own content library
• ✓ Export metadata (titles, stats, durations) about content you own for analysis

Important: Third-party platforms may restrict automated access to content from their platforms. You are solely responsible for ensuring your use of TokHarvest complies with any applicable platform’s Terms of Service. TokHarvest does not encourage or condone violations of any platform’s terms.

4. Prohibited Use — What You MAY NOT Do

You are strictly prohibited from using TokHarvest to:

• ✗ Import or store content you do not own or do not have explicit permission to manage
• ✗ Commercially redistribute, sell, or license content imported from third parties
• ✗ Use TokHarvest in a way that violates any third-party platform’s Terms of Service
• ✗ Use managed content to infringe on copyright, trademark, or other intellectual property rights
• ✗ Attempt to circumvent any platform’s technical measures, DRM, or access controls
• ✗ Use TokHarvest for any illegal purpose or in violation of any applicable laws
• ✗ Harass, stalk, or infringe the privacy of any individual using managed content
• ✗ Resell or sublicense access to TokHarvest without express written consent

5. User Responsibility

You are solely responsible for ensuring you have the legal right to import, store, or manage any content you handle using TokHarvest. TokHarvest provides a technical tool — the legal responsibility for how you use that tool rests entirely with you.

We cannot verify the ownership or rights status of any content you choose to manage. By using the Service, you represent and warrant that you will only manage content you have the right to access and store.

If you are unsure whether you have the right to manage specific content, err on the side of caution and do not use TokHarvest for that content.

6. Third-Party Platforms

TokHarvest is not affiliated with, endorsed by, or in any way officially connected to TikTok, ByteDance Ltd., Instagram, Meta Platforms Inc., YouTube, Google LLC, Twitter/X, or any other platform. Use of those platforms is governed entirely by their own respective Terms of Service.

TikTok™ is a registered trademark of ByteDance Ltd. TokHarvest has no partnership, sponsorship, endorsement, or employment relationship with ByteDance Ltd. or any of its affiliated companies.

It is your responsibility to comply with the Terms of Service of any third-party platform from which you use TokHarvest to access or download content.

7. Intellectual Property

The TokHarvest software, website, branding, logos, and documentation are owned by TokHarvest and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works of our materials without express written consent.

Content downloaded through TokHarvest retains the copyright of its original creator. Downloading a video does not transfer any copyright or other intellectual property rights in that content to you.

8. DMCA / Copyright Takedown

TokHarvest respects intellectual property rights and expects its users to do the same. If you believe content in our system infringes your copyright, please send a DMCA notice to:

Your notice must include:

• • A description of the copyrighted work you claim has been infringed
• • The URL or location of the allegedly infringing content
• • Your full name and contact information (email, address, phone)
• • A statement of good faith belief that the use is not authorised
• • A statement under penalty of perjury that the information is accurate

We will respond to valid DMCA notices within 5 business days.

9. Service Availability

We provide TokHarvest “as is” and “as available” without any warranty of uninterrupted uptime, accuracy, or fitness for a particular purpose. We may suspend or discontinue the Service at any time, with or without notice.

Third-party services and APIs that TokHarvest relies on (such as content delivery networks, media APIs, and payment processors) may change, restrict, or discontinue their services at any time, which may affect TokHarvest’s functionality without warning.

10. Limitation of Liability

To the maximum extent permitted by applicable law, TokHarvest’s total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to TokHarvest in the three (3) months preceding the claim.

Under no circumstances shall TokHarvest be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.

11. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may also terminate your account at any time from your account settings.

Upon termination for cause (ToS violation), no refund will be issued. For voluntary cancellations by users in good standing, please see our Refund Policy.

12. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where required, send an email notification to registered users.

Your continued use of TokHarvest after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
